1. INTRODUCTION PideloRush.com is owned by PideloRush LLC.
PideloRush does not handle home deliveries. All orders placed through the platform are strictly for in-store pickup. This applies to restaurants, pharmacies, retail stores, and hotels.
PideloRush is a digital platform that allows users to place online orders at restaurants, pharmacies, retail stores, and hotels for pickup, dine-in ordering, or hotel room service. By using the platform, users agree to these Terms and Conditions.
2. DEFINITIONS
• "User": Any person who uses the platform to place orders.
• "Merchant": A business registered and approved to offer products or services through the platform.
• "PideloRush": The platform operated by PideloRush LLC.
3. REGISTRATION AND ACCOUNTS
• Users can register directly.
• Merchants may register, but must be approved by the Super Admin before operating.
• Users are responsible for maintaining the confidentiality of their login credentials.
4. FEATURES
• In-store pickup orders.
• Dine-In ordering.
• Ordering directly from the table.
• Gifting orders via unique codes.
• Room service orders in affiliated hotels.
5. PAYMENTS AND FEES
• Payments are processed via Stripe Connect.
• A 4% commission is added to the total of the user's order.
• Monthly subscription fees: $55 for restaurants and retail stores, $155 for hotels and
supermarkets. All contracts are annual and auto-renewed.
6. MERCHANT RESPONSIBILITIES
• Prepare orders within the estimated time.
• Designate a pickup area.
• Ensure product quality.
• Resolve any issues directly related to incorrect or defective orders.
7. USER RESPONSIBILITIES
• Provide truthful and accurate information.
• Pick up orders on time.
• Communicate with merchants exclusively via the in-app chat.
• Claims about orders placed outside the platform will not be addressed.
8. CANCELLATIONS AND REFUNDS
• Each merchant defines its own cancellation policy.
• PideloRush is not responsible for refunds but facilitates communication between
users and merchants.
9. LIMITATION OF LIABILITY PideloRush acts solely as a marketplace facilitator registered
under the laws of the Government of Puerto Rico. PideloRush is not liable for:
• Damages caused by users inside merchant locations.
• Conflicts, disputes, or issues between users and merchants.
• Physical or health damages resulting from the consumption of products (e.g., burns,
food poisoning).
• Incorrectly prepared or delivered orders (merchant's sole responsibility).
• PideloRush LLC does not provide phone support. All issues must be resolved via the in-app support chat.
• PideloRush LLC is not obligated to permanently store chat history.
• Technical failures, service interruptions, or force majeure events.
• Inaccurate or misleading content uploaded by merchants.
• Inappropriate behavior by users or merchants on or off the platform.
10. PROHIBITED CONDUCT AND MISUSE
• Users may not use the platform for fraudulent, illegal, defamatory, or abusive purposes.
• Bots, price manipulation, resale of orders, or any activity that disrupts normal
operation is strictly prohibited.
11. DISCLAIMER OF WARRANTIES
• PideloRush does not guarantee uninterrupted or error-free service.
• No implied warranties regarding the suitability or satisfaction of products are
offered.
12. INDEMNIFICATION
• Users and merchants agree to indemnify and hold harmless PideloRush LLC from any claims, damages, losses, or expenses (including legal fees) arising from misuse or violation of these terms.
13. RELATIONSHIP BETWEEN PARTIES
• Use of the platform does not create any employment, agency, partnership, or franchise relationship between PideloRush and users or merchants.
14. DISPUTE RESOLUTION
• Parties agree to attempt amicable resolution via in-app support before pursuing legal action.
• Any unresolved dispute will be submitted to the appropriate courts in Puerto Rico.
15. MINIMUM AGE
• The platform is only available to individuals 18 years or older, or minors under the supervision of an adult.
16. MODIFICATIONS These terms are subject to change. Users will be notified via the platform.
17. GOVERNING LAW These terms are governed by the laws of the Commonwealth of Puerto Rico. PideloRush LLC is a for-profit corporation legally established in Puerto Rico and complies with all applicable local laws and regulations.
